1. General provisions.
1.1. These item purchase–sale rules (hereinafter Rules) are parts of a binding legal document, setting out the Customer and Mados kulto Individual Enterprise Mados kultas (hereinafter Seller) rights and obligations, item procurement and payment terms, item delivery and return procedure, parts responsibilities and other item purchase–sale related provisions buying goods online in store www.madoskultas.lt.
1.2. The Seller has the right to make corrections within the Rules at any time, following Laws of Lithuanian Republic. Any changes made start being applied from the moment of announcement. If the Customer continues usage of the online store, he agrees with all the corrections made. 

1.3. All the persons having reached the age of majority, whose legal capacity is not limited under the law and underage persons from 14 to 18 years with the consent of their parents or guardians, except for the cases when they independently dispose of their income, have the right to make a purchase in store www.madoskultas.lt

 

2. Personal Data Protection.
2.1. The Customer may order items at www.madoskultas.lt online store by registering and submitting the data required at registration.
2.2. The Customer is responsible for indicating the correct personal data when registering, including name, surname, adress, telephone number and email.
2.3. By accepting these rules Customer agrees that the personal data provided by the Customer should be processed by the goods sales and services provision of www.madoskultas.lt online store for the purposes of the Seller’s direct marketing.

2.4. The Customer agrees that informative notifications, necessary for order fulfilment, should be sent by email.

2.5. If the Customer does not confirm the usage of his personal data for the purposes of the Seller‘s direct marketing, Customer must inform Seller via email.

2.6. The Seller confirms that personal data that Customer provides will be used only within the online store www.madoskultas.lt for the purposes of the Seller‘s direct marketing (except cases when the customer notifies unwillingness to share his personal information for the use of Seller‘s direct marketing). The Seller ensures confidiality of any personal Customer‘s data to any third parties, unless it is required for the process of item delivery. For all the other cases, LR Laws are being applied.

2.7. The Customer agrees with a Seller‘s right to use his personal data according to the the Rules.

 

3. Sale and Purchase Agreement

 3.1. The Agreement between the Buyer and the Seller is considered to be concluded from the moment when the Customer, having formed a shopping cart, filled the necessary data to the form of the order (first name, last name, telephone number, shipping address, etc.), selected the delivery and payment methods, familiar with Purchase conditions and click the button "Continue", confirming the order.

3.2. Sale and Purchase Agreement continues to be legal until the complete fulfillement of the specific obligations.
3.3. After the item is sent, the Customer gets the confirmation message via email.


4. Customer’s rights and obligations.

 4.1. The Customer has the right to make a purchase at the www.madoskultas.lt online store according to the procedure laid down in these Rules and other informative sections of this e-shop.

4.2. The Customer has the right to cancel the purchase-sale agreement with the www.madoskultas.lt online store via e-mail informing the Seller about cancelation in 7 days after the item delivery.

4.3. The Customer who for some reason canceled the purchase-sale agreement with the www.madoskultas.lt online store, is committed to send the returning item up to 3 working days after the notice of delivery. 

4.4. If the Customer has supplied inaccurate information or incorrect address, the Customer undertakes to pay all of the costs arising from the delivery, or other additional costs.

4.5. The Customer understands that the online store goods in their color, shape and other parameters can not fully satisfy the actual product sizes, shapes and colors used to display the characteristics of the buyer. 4.6. If the Customer’s data indicated in the registration form have altered, the Customer must renew them immediately.

4.7. The Customer undertakes to accept the ordered items and pay the settled price.

 

5. Seller‘s Rights and Obligations

 5.1. The Seller has the right to unilaterally adjust the rules. Subject to the rules in force at the time of booking.

5.2. The Seller undertakes to deliver the items ordered by the Customer to the address indicated by the Customer.

5.3. The Seller undertakes to send goods up to 3 days after the received payment.

5.4. The Seller undertakes to provide the Customer with conditions for the appropriate use of the www.madoskultas.lt online store services.

5.5. The Seller has the right to cancel an order if the Customer does not complete an online payment in 1 working day.

5.6. The Seller has the right to refuse accepting the returning item if it is damaged due to insufficient care.

5.7. The Seller does not accept liability for incorrect, and (or) incomplete information about the product. Its color, shape and other parameters may be used to vary the characteristics of the computer or monitor and (or) settings.

 

6. Order, prices, payment procedure, terms.
6.1. All the goods prices indicated in the www.madoskultas.lt online store include VAT.
6.2. There are two ways to pay for the items:

6.2.1. The Customer may pay for the items by cash to the courier upon delivery or picking up items at the boutique Mados Kultas in Klaipeda, Tiltu 26A (Friedrich's arcade).
6.2.2.  The Customer may pay for the purchase using the electronic banking system. The Customer makes the money transfer directly into the current account of www.madoskultas.lt online store. In this case, the bank in whose electronic banking system the payment is made bears the responsibility for the data safety. The Customer may also pay by a bank transfer.
6.3. The Customer undertakes to pay the ordered goods in 1 working day of Seller's proposed form of payment. If the buyer within the time limit does not pay the price, it is considered that the buyer refuses to perform the contract, the Seller has the right to suspend the execution of orders.

 

 

 

7. Delivery

 7.1. The Customer chooses the most suitable method of delivery. Items may be delivered by courier or goods may be picked up at the boutique Mados Kultas in Klaipeda, Lithuania ,Tiltu 26A.

7.2. Item delivery:

7.2.1. The Customer, who makes the order and chooses the delivery service, undertakes to accurately indicate the place of delivery where he could be reached during working days, working hours.  

7.2.2. If at the time of delivery, the Customer notices, that the parcel is damaged, he must note this in the parcel delivery document presented by the courier, or write down a comment concerning the damage. The Customer must do this in the presence of the courier. If these steps are not taken, the Seller is exempted from responsibility to the Customer concerning the damage of those items (inccurred due to the damage of the package), which were not indicated by the Customer in the courier item delivery document.

7.3. Pick up items in the boutique Mados Kultas:

7.3.1. The Customer may pick up his goods at the boutique Mados Kultas in Klaipeda, Tiltu 26A during the working days from 11am to 7pm and on Saturdays from 11am to 4pm.

7.4. The Seller delivers the goods to the Customer in accordance with the terms indicated in the item descriptions. In exceptional cases, the delivery may be delayed due to unforeseen circumstances, not pertaining to the Seller. In such a case, the Seller undertakes to contact the Customer immediately and settle the commodity delivery conditions.

7.5. More information in detail regarding item delivery may be found in the section „Delivery“.

 

8. Goods return and exchange.

 8.1.The goods return is performed according to the Order of the Minister of Economy No 217 “On the approval of rules for items return and exchange”, of 29 June 2001.

8.2. To return the goods, the Customer must send the returned items using the Seller‘s ordered courier service at the arranged time, not later than 3 days after the notice of wilingness to return the items.

8.3.  The money for the returned items is transferred only into the Customer‘s bank account up to 15 days after the notice of item return.  The Customer is responsible for the cost of the returning items.

8.4. Product replacement and recovery are possible only in original package and if the product was not used, the product is undamaged and without losing merchantable, of the same set as delivered to the Customer, of unaltered appearance (undamaged labelling, non-removed protective sheet, etc.) (this section does not apply to defective returned items). The purchase document of the returned goods must be presented.

 

9. Final Provisions

9.1. These goods purchase-sale Rules are set in accordance with the legislation of the Republic of Lithuania.
9.2. All disputes arising between the Buyer and the Seller shall be dealt with by negotiation. Parties fail to agree, the disputes are settled LR procedure established by law.
